2. Hosting und Server-Logfiles

Diese Website und die App werden bei Netlify, Inc. (San Francisco, USA) gehostet. Beim Aufruf werden technisch notwendige Daten (IP-Adresse, Datum und Uhrzeit, aufgerufene Seite, Browser) verarbeitet, um die Website auszuliefern und abzusichern. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO. Die Übermittlung in die USA erfolgt auf Grundlage des EU-US Data Privacy Framework bzw. von Standardvertragsklauseln.

3. Keine Tracking-Cookies, lokale Schriftarten

Wir setzen keine Analyse- oder Marketing-Cookies ein. Schriftarten werden von unserem eigenen Server geladen; es findet keine Verbindung zu Google Fonts statt. Im Browser werden nur technisch notwendige Angaben lokal gespeichert (gewählte Sprache, Anmeldesitzung der App und – falls hochgeladen – Ihr Logo), § 25 Abs. 2 TDDDG.

4. Kundenkonto und Nutzung der App

Für die Anmeldung und die Zählung des monatlichen Fotokontingents verarbeiten wir E-Mail-Adresse, Firmenname, Passwort (verschlüsselt gespeichert) sowie Zeitpunkt und Anzahl der Bildbearbeitungen. Anbieter ist Supabase, Inc.; die Daten werden in einem Rechenzentrum in der EU (Frankfurt) gespeichert. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO (Vertrag).

5. Bildbearbeitung mit KI

Die von Ihnen hochgeladenen Fahrzeugfotos und gegebenenfalls Ihr Logo werden zur Bearbeitung an die Gemini API von Google (Google Ireland Ltd. / Google LLC) übermittelt und das Ergebnis an Ihren Browser zurückgegeben. Wir speichern Ihre Bilder nicht auf unseren Servern. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO. Eine Übermittlung in die USA erfolgt auf Grundlage des EU-US Data Privacy Framework bzw. von Standardvertragsklauseln. Bitte laden Sie keine Fotos hoch, auf denen Personen erkennbar sind.

6. Zahlung

Zahlungen werden über SumUp abgewickelt. Dabei gelten die Datenschutzhinweise von SumUp. Wir erhalten nur die für die Zuordnung der Zahlung nötigen Angaben (Name, E-Mail, Betrag, Datum). Rechtsgrundlage: Art. 6 Abs. 1 lit. b und c DSGVO.

7. Kontakt per E-Mail oder WhatsApp

Wenn Sie uns kontaktieren, verarbeiten wir Ihre Angaben zur Bearbeitung der Anfrage (Art. 6 Abs. 1 lit. b DSGVO). Bei Nutzung von WhatsApp gelten zusätzlich die Datenschutzbestimmungen von WhatsApp Ireland Ltd.

8. Speicherdauer

Kontodaten speichern wir für die Dauer des Vertrags und löschen sie danach, soweit keine gesetzlichen Aufbewahrungspflichten (z. B. 10 Jahre für Buchungsbelege) bestehen.

9. Ihre Rechte

Sie haben das Recht auf Auskunft, Berichtigung, Löschung, Einschränkung der Verarbeitung, Datenübertragbarkeit und Widerspruch (Art. 15–21 DSGVO). Zudem können Sie sich bei einer Datenschutz-Aufsichtsbehörde beschweren, z. B. beim Bayerischen Landesamt für Datenschutzaufsicht (BayLDA), Promenade 18, 91522 Ansbach.

Allgemeine Geschäftsbedingungen (AGB)

1. Geltungsbereich

Diese AGB gelten für die Nutzung von SCG Auto Studio (nachfolgend „Dienst“), angeboten von Alex Gómez, Spain Consulting Group (nachfolgend „Anbieter“). Das Angebot richtet sich ausschließlich an Unternehmer im Sinne von § 14 BGB.

2. Leistung

Der Dienst ist eine Web-App, mit der Fahrzeugfotos mithilfe künstlicher Intelligenz bearbeitet werden (z. B. Hintergrund, Licht, Kennzeichen). Der Umfang richtet sich nach dem gebuchten Paket (Starter: 150, Pro: 500 Bearbeitungen pro Monat). Fehlgeschlagene Bearbeitungen werden nicht angerechnet. Das Kontingent gilt jeweils für den bezahlten Monatszeitraum; nicht genutzte Bearbeitungen verfallen an dessen Ende.

3. Vertragsschluss, Laufzeit, Preise

Der Vertrag kommt mit Zahlung des gewählten Pakets und Freischaltung des Zugangs zustande. Die Laufzeit beträgt jeweils einen Monat ab Zahlungsdatum und verlängert sich nicht automatisch. Ohne erneute Zahlung wird der Zugang 5 Tage nach Ablauf deaktiviert. Die angegebenen Preise sind Endpreise; gemäß § 19 UStG wird keine Umsatzsteuer berechnet.

4. Pflichten des Kunden

• Der Kunde lädt nur Fotos und Logos hoch, an denen er die erforderlichen Rechte besitzt.
• Der Kunde prüft jedes Ergebnis vor der Veröffentlichung und ist dafür verantwortlich, dass seine Fahrzeuganzeigen den tatsächlichen Zustand des Fahrzeugs zutreffend darstellen.
• Zugangsdaten sind vertraulich zu behandeln und dürfen nicht an Dritte weitergegeben werden.

5. Nutzungsrechte

Der Kunde darf die erzeugten Bilder zeitlich und räumlich unbeschränkt für eigene Zwecke nutzen, insbesondere für Fahrzeuginserate, Website und Social Media.

6. Verfügbarkeit

Der Anbieter bemüht sich um eine hohe Verfügbarkeit. Der Dienst nutzt Leistungen Dritter (u. a. Hosting und KI-Bildbearbeitung); vorübergehende Einschränkungen, etwa durch Wartung oder Störungen bei diesen Anbietern, sind möglich. KI-Ergebnisse können variieren; ein bestimmtes Ergebnis wird nicht geschuldet.

7. Haftung

Der Anbieter haftet unbeschränkt bei Vorsatz und grober Fahrlässigkeit sowie bei Verletzung von Leben, Körper oder Gesundheit. Bei leicht fahrlässiger Verletzung wesentlicher Vertragspflichten ist die Haftung auf den vertragstypischen, vorhersehbaren Schaden, höchstens auf die Vergütung der letzten drei Monate, begrenzt. Im Übrigen ist die Haftung ausgeschlossen.

8. Schlussbestimmungen

Es gilt das Recht der Bundesrepublik Deutschland. Gerichtsstand ist, soweit zulässig, Passau.

Política de privacidad

2. Alojamiento

La web y la app se alojan en Netlify, Inc. (EE. UU.). Al visitarla se tratan datos técnicos necesarios (IP, fecha y hora, página, navegador) para servirla y protegerla. Base legal: art. 6.1.f RGPD. Transferencia a EE. UU. amparada por el EU-US Data Privacy Framework o cláusulas contractuales tipo.

3. Sin cookies de seguimiento, tipografías locales

No usamos cookies de analítica ni de marketing. Las tipografías se sirven desde nuestro propio servidor (sin Google Fonts). En el navegador solo se guarda lo técnicamente necesario: idioma, sesión de la app y, si lo subes, tu logo.

4. Cuenta y uso de la app

Para el acceso y el cómputo del cupo mensual tratamos email, nombre de empresa, contraseña (cifrada) y fecha y número de ediciones. Proveedor: Supabase, Inc., con los datos alojados en la UE (Fráncfort). Base legal: art. 6.1.b RGPD (contrato).

5. Edición de imágenes con IA

Las fotos que subes y, en su caso, tu logo se envían a la API Gemini de Google para su edición y el resultado vuelve a tu navegador. No guardamos tus imágenes en nuestros servidores. Base legal: art. 6.1.b RGPD. Transferencia a EE. UU. amparada por el Data Privacy Framework o cláusulas tipo. No subas fotos en las que se reconozca a personas.

6. Pago

Los pagos se procesan con SumUp, según su política de privacidad. Solo recibimos los datos necesarios para asignar el pago (nombre, email, importe, fecha).

7. Contacto por email o WhatsApp

Si nos escribes, tratamos tus datos para atender la solicitud. En WhatsApp se aplica además la política de WhatsApp Ireland Ltd.

8. Conservación

Conservamos los datos de la cuenta mientras dure el contrato y después los borramos, salvo obligaciones legales de conservación (p. ej., 10 años para justificantes contables).

9. Tus derechos

Tienes derecho de acceso, rectificación, supresión, limitación, portabilidad y oposición (arts. 15–21 RGPD), y a reclamar ante una autoridad de control, p. ej. el BayLDA (Promenade 18, 91522 Ansbach, Alemania).

Condiciones generales

1. Ámbito

Estas condiciones regulan el uso de SCG Auto Studio («el servicio»), ofrecido por Alex Gómez, Spain Consulting Group. El servicio se dirige exclusivamente a empresas y profesionales.

2. Servicio

Web app para editar fotos de vehículos con inteligencia artificial (fondo, luz, matrícula). El volumen depende del plan (Starter: 150; Pro: 500 ediciones al mes). Las ediciones fallidas no cuentan. El cupo no usado no se acumula.

3. Contratación, duración y precio

El contrato se perfecciona con el pago del plan y la activación del acceso. Dura un mes desde la fecha de pago y no se renueva automáticamente. Sin nuevo pago, el acceso se desactiva 5 días después. Precios finales: sin IVA según § 19 UStG.

4. Obligaciones del cliente

• Subir solo fotos y logos sobre los que tenga derechos.
• Revisar cada resultado antes de publicarlo; el cliente es responsable de que sus anuncios reflejen el estado real del vehículo.
• No ceder sus credenciales a terceros.

5. Derechos de uso

El cliente puede usar las imágenes generadas sin límite de tiempo ni territorio para sus propios fines (anuncios, web, redes).

6. Disponibilidad

El servicio depende de terceros (alojamiento, IA) y puede tener interrupciones puntuales. Los resultados de la IA pueden variar; no se garantiza un resultado concreto.

7. Responsabilidad

Responsabilidad ilimitada por dolo, culpa grave y daños a la vida o la salud. Por culpa leve en obligaciones esenciales, limitada al daño típico previsible y como máximo al importe de los últimos tres meses. En lo demás, excluida.

8. Ley y jurisdicción

Derecho alemán. Tribunales de Passau (Alemania), en la medida en que la ley lo permita.

5. AI image editing

Photos you upload and, if applicable, your logo are sent to Google’s Gemini API for editing and the result is returned to your browser. We do not store your images on our servers. 6. Payment

Payments are processed by SumUp under its privacy policy. We only receive the data needed to match the payment (name, email, amount, date).

If you contact us, we process your data to handle the request. WhatsApp Ireland Ltd.’s privacy policy also applies when using WhatsApp.

8. Retention

Account data is kept for the duration of the contract and then deleted, unless statutory retention periods apply (e.g. 10 years for accounting records).

9. Your rights

You have the right of access, rectification, erasure, restriction, portability and objection (Arts. 15–21 GDPR), and the right to lodge a complaint with a supervisory authority, e.g. BayLDA (Promenade 18, 91522 Ansbach, Germany).

Terms and conditions

1. Scope

These terms govern the use of SCG Auto Studio (“the service”) provided by Alex Gómez, Spain Consulting Group. The service is offered exclusively to businesses.

2. Service

A web app for editing vehicle photos with AI (background, light, licence plate). Volume depends on the plan (Starter: 150; Pro: 500 edits per month). Failed edits don’t count. Unused quota does not carry over.

3. Contract, term and price

The contract is concluded upon payment of the plan and activation of access. It runs for one month from the payment date and does not renew automatically. Without a new payment, access is deactivated 5 days later. Final prices: no VAT charged under § 19 UStG.

4. Customer obligations

• Only upload photos and logos you hold the rights to.
• Review every result before publishing; the customer is responsible for listings accurately reflecting the vehicle’s real condition.
• Keep login details confidential.

5. Usage rights

The customer may use the generated images without time or territorial limits for its own purposes (listings, website, social media).

6. Availability

The service relies on third parties (hosting, AI) and may be temporarily limited. AI results can vary; no specific result is guaranteed.

7. Liability

Unlimited liability for intent, gross negligence and injury to life or health. For slight negligence regarding essential obligations, liability is limited to typical foreseeable damage and at most to the fees of the last three months. Otherwise excluded.

8. Governing law

German law applies. Place of jurisdiction, where permitted: Passau, Germany.
